Need To VentI'm sooooooooooo pi$$ed off with my work at the mo its unreal.
A few weeks ago I complained about another member of staff not pulling their weight, and today I went in to start my shift as normal only to be pulled into the office to be told that the owner wants to give me a written warning for complaining. I told him to shove his warning where the sun doesnt shine as I wasnt prepared to accept it. The real pi$$er is that I'm not the only one to complain about this person but nothing has been said to anyone else and the lazy cow we're all moaning about has got off scott free. I think I've got him by the short and curlies as he hasnt followed disaplinery(sp) procedure and if I mention ACAS he $hit himself coz they helped take him to the cleaners last year when some one else took him the full way.

Well, well, well went in today only to be told that he's decided not to give me the warning afterall (probably because he messed up) but he has demoted me from a senior cashier to general dogsbody, because he feels I need "An Attitude Adjustment". I have now started a diary and every thing he does that has a detrimental effect on my job is being recorded. I'll give the wee $hit enough rope to hang himself.
I still feel it unfair being penalised for using my statutory right to complain but this guy is a law unto himself. ACAS have said they cant get involved while its still an internal issue but if push comes to shove and I'm forced to leave through his actions or any other staff members actions then they will take him for constructive dismissal

Hi Gina, we dont have a personel department, it looks like I'm getting shafted anyway because I was informed yesterday that I am now being investigated for bullying as two complaints have been made against me, they wont/cant tell by who but it doesnt take a genius to work it out. One of them is the girl who I made the initial complaint about and the other is her "Best Mate" who BTW I have never worked a shift with. So I'd like to know how I can bully someone I've never worked with and someone who I work with once every two weeks. Another Manager phoned me yesterday and when I explained everything to her she said that I had a good case for constructive dismissal and thats the last thing they want to see happening. So I'm writing a formal letter and I'm putting everything in it from staff members who are privy to personel info discussing it on the shop floor to having to being ignored by staff because I complained about their mate. Its all one big mess that keeps getting worse as the days go on.
Sorry to go on peeps but I'm finding it all quite upsetting to say the least. x x x x

I'm no expert, but yes that sounds like constructive dismissal to me!
Yes go the formal route, and get your evidence together. No one should be made to feel like that at work when they haven't done anything!

Although I work in HR, I don't do the sort of work anymore where I give advice...I work in the systems area. But from experience all I can say is, if you've got a problem at work and you know you're right and they're wrong, there is ALWAYS someone, somewhere who you can complain to. Just get your facts and evidence together.

Thank you Gina for all your advice, I'll just have to wait and see what this week brings, the manageress was saying last week that the owner might just go along the route of everyone apologising to one another!!!!! But since I've done nothing wrong I dont see why I should, as far as I know he still has to address the issues I raised in my letter of grievance especially the issues regarding confidentiality. the manageress is still talking about us all going out for a xmas night out I politely told her it aint gonna happen lol

I've started keeping a diary and I'm writing everything in it so regardless to whether they sack me or I leave, their going down with me.

I and some of the other drivers at our company are having similar problems with our manager and we have taken to recording every conversation we have with them, this might be an idea for you, get yourself a dictaphone and switch it on record whenever you are in a situation that may be detrimental to you

My husband has used his iPod touch to record meetings (it's got a recording application on it).

Just a quick update, I recieved a letter from my work today asking me to attend an investigatory meeting regarding "complaints of gross mis conduct namely the abuse of the personal harassment policy" they a dirty shower of $hit. I'd love to know who I'm guilty of harrassing and when I'm supposed to have done it. How can you harass people that you dont even talk to, the mind bogles. I'll keep you updated when I go for the meeting.

You should take a representative in with you to witness everything that is said. If they tell you that you cant then they're not doing it legitimately.

Hi Gina, apparently when I handed in my letter of greivance, the woman I had initially complained about and her slimy mate also handed in letters, when I went in for the meeting it was the allegations on these letters that were to be disscussed all the ponts in them were blown out the water as I've never worked a shift with one of them and the other one is just a born liar, which I did point out strongly lol. As I stated at the meeting I feel that regardless to what I say to defend myself the Boss has already made her mind up as she's the other twos "buddy" this was strongly refuted but I will wait and see. I'm honestly pauys st caring now the hunt for a new job is well and truly on.

I can only have a witness present if its a disapplinary meeting if its an investigation I have no statutory right to anyone else there. Its all a pile of big girls pants.

That's constructive dismissal, i.e. when you feel pushed out of your job. Are you in a situation where you could get a lawyer? I don't know much about this side of it so I can't help much. A friend of mine's mother had a similar situation. She got a lawyer and in the end (can't remember all that happened) she kept her jobs and the troublemakers left!
You do what's right for you, though. You shouldn't feel harrassed at your job!
